A Japanese company holds the trademark rights to “Kaka Bear,” a highly recognized brand in the plush toy industry. Since 2018, a Guangzhou-based Chinese company has persistently manufactured and sold plush toys counterfeiting the Kaka Bear image. Despite receiving administrative penalties and customs seizures, the Chinese company continued its violations — registering similar trademarks and splitting transaction accounts. Its products were sold across major domestic and international e-commerce platforms, generating substantial cumulative transaction volumes

The Japanese company repeatedly demanded the Chinese company cease infringement, but was ignored.

Outcome

The Japanese company entrusted SuitWin Recovery. Through proceedings at the Guangzhou Intermediate People’s Court, the Chinese company was ordered to compensate the Japanese company RMB 4 million, immediately cease infringement, and destroy the infringing products and molds.
